Terms of Service

1. Agreement

By purchasing any Fernpoints product, you agree to these terms. They apply between you and Fernpoints Pty Ltd, a small-batch illustration studio registered in New South Wales, Australia.

2. Products and pricing

All prices are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable. We reserve the right to cancel any order if a pricing error has occurred, in which case a full refund is issued.

All products are digital files delivered via download link. No physical goods are shipped.

3. Payment

Payment is processed securely through Stripe at the time of purchase. We accept all major debit and credit cards. No card details are stored on our servers.

4. Delivery

All products are delivered digitally. After a successful payment you receive an email containing a download link. Downloads are available immediately. See our Delivery page for full details.

5. Licence

When you purchase a Fernpoints pack, you receive a perpetual, non-exclusive, royalty-free commercial licence to use the illustrations in your own creative work. You may:

• Use the illustrations in unlimited commercial releases, including apps, products, print, and video
• Use the illustrations for clients and in work-for-hire productions
• Modify, colour, and rearrange the files as needed

You may not:

• Redistribute, resell or sublicense the raw files
• Share download links or files with anyone else
• Include unmodified files in another clipart pack, icon set, or stock library for sale
• Claim authorship of the illustrations themselves

Full details are in our Refund Policy. Summary: 30 days, no questions asked.

7. Your consumer rights

As an Australian consumer, you have rights under the Australian Consumer Law (Competition and Consumer Act 2010). Nothing in these terms restricts those statutory rights. Digital products are subject to the licence terms in Section 5, and you acknowledge that digital goods cannot be returned in the traditional sense once downloaded.

8. Limitation of liability

Our liability to you is limited to the purchase price of the product(s) you ordered. We are not liable for indirect losses, including lost profits or consequential damages, to the extent permitted by law.

9. Intellectual property

All content on this website, including illustrations, images, copy, and branding, belongs to Fernpoints Pty Ltd. The licence granted upon purchase is limited to Section 5.

10. Governing law

These terms are governed by the laws of the State of New South Wales, Australia. Any disputes arising from these terms will be resolved in the courts of New South Wales.

11. Changes

We may update these terms from time to time. The current version will always be available here with a revised date.
